Argentina Trademark Registration

Application Route
Argentina has not joined the Madrid System. Therefore, trademark registration can only be submitted through the 'direct national registration' route.
Required Documents for Trademark Registration
- Trademark specimen
- Designated class(es) and specific goods/services
- Applicant's name and address
- Scanned copy of the signed and stamped Power of Attorney (POA)
- Priority document (if priority is claimed, along with a Spanish translation certified by a qualified translator in Argentina)
Note: Individual applicants must provide marital status. If married, the spouse’s name must be included.
Trademark Registration Process
- Provide trademark specimen
- Prepare trademark application documents
- Submit the trademark application to the trademark office
- Examination by the trademark office
- Issuance of the Acceptance Notification
- After passing examination, the trademark enters the publication phase
- If no opposition is filed during the publication period, the trademark registration certificate is granted
Important Notes
- Argentina follows the 'first-to-file' principle for trademark registration, though under special circumstances, rights may be claimed based on 'first-to-use.'
- Argentina adopts the Nice Classification system and does not accept multi-class applications (one application per class).
- If the applicant does not reside in Argentina, a local Argentine agent must be appointed to handle the application.
- If a registered trademark is not used in Argentina for 5 consecutive years, any party may apply for its cancellation (except in cases of force majeure).
- Argentina follows a 'publication before examination' system, meaning the trademark is published for opposition before substantive examination. Even if no opposition is filed, the trademark may still face registration challenges during the examination stage.
Validity Period and Renewal
A trademark in Argentina is valid for 10 years from the registration date.
Renewal can be filed within 6 months before expiration, with a 6-month grace period. Each renewal extends the validity by 10 years.
