Canada is a major trading nation with significant reliance on foreign trade. China is an important trading partner for Canada. Due to Canada's developed economy, trade demands, and favorable immigration policies, many Chinese individuals choose to establish brands in Canada to gain business advantages.
Required Application Materials for Trademark Registration
- Name or logo of the trademark (English is recommended);
- Selection of the class(es) and specific items of goods/services for the application;
- Completion of the trademark registration application form (our company provides a template);
- Provision of the applicant's basic information: scanned copy of ID card/passport/business license.
Trademark Registration Application Process
- Submit application materials and pay the application fee.
- Acknowledgement: CIPO (Canadian Intellectual Property Office) issues an acknowledgement notice and formally accepts the application.
- Examination: Formal examination + substantive examination. The government standard is to issue a preliminary examination report within 6 months, but it often takes over a year currently. The examination time is closely related to the scope of the registration applied for.
- Publication: After receiving the approval notice, CIPO publishes the trademark in the official gazette. The publication period is 2 months.
- Final Approval: If no third party files an opposition, CIPO will send the final approval notice 3 months after publication.
- Registration: If the trademark is already in use, the applicant can obtain the registration certificate and other documents immediately after final approval. If the trademark is not yet in use, the certificate can only be collected after the trademark has been put into use.
Protection Period and Renewal
A Canadian trademark is valid for 15 years. After 15 years, if needed, the trademark holder can pay a renewal fee to extend the validity for another 15 years.
