- Applicant information: name, address, nationality, etc.;
- Clear trademark specimen;
- List of goods or services;
- Priority document (if applicable);
- Scanned copy of the signed and stamped Power of Attorney (POA).
Trademark Registration Process
- Application Submission
- Formal Examination: If the trademark application is deemed unacceptable, a correction notice will be issued. The applicant must make corrections within 30 working days. After passing formal examination, the application proceeds to the next stage.
- Publication: After passing formal examination, the application will be published in the Official Gazette of Chile. Any third party may file an opposition within 30 working days. If no opposition is filed or if the opposition is unsuccessful, the trademark application proceeds to the next stage.
- Substantive Examination: If the examiner identifies any non-compliance, a notification of refusal will be issued. The applicant must respond within 30 working days of receiving the notice. If the refusal is upheld, the applicant may appeal to the Industrial Property Court of Appeals.
- Registration: After passing substantive examination, the trademark will be approved for registration. The applicant must pay the registration fee within 60 working days.
Validity Period and Renewal
A trademark is valid for 10 years from the registration date.
Renewal can be filed within 12 months before expiration, with a 30-day grace period (non-extendable). Each renewal extends the validity by 10 years.
