India Trademark Registration
India, officially the Republic of India, is one of China's friendly neighbors and also one of the fastest-growing economies in the world. As a rapidly emerging and important international market, India has attracted increasing attention from overseas business professionals. As the only developing country globally comparable to China in terms of population size, the density of trademark application registrations in India is considerable.
Required Documents for India Trademark Registration
- Applicant Qualification Proof:
- Applicant’s Detailed Information (in Chinese and English): Includes name or entity name, nature, nationality, detailed address, postal code, and contact information.
- Electronic Trademark Specimen.
- Goods/Services Names and Classification (according to the International Nice Classification adopted by India).
- Signed Power of Attorney.
- For Non-English Word Trademarks: The applicant must provide the corresponding English translation and interpretation of the word trademark.
India Trademark Registration Process
- Formal Examination: After submission, the application documents, trademark specimen, Power of Attorney, and other materials are reviewed for compliance. If compliant, a filing date and application number are granted.
- Substantive Examination: The trademark is reviewed for registrability, potential conflicts with prior registered or pending trademarks, and compliance with prohibitive clauses of the trademark law. If the trademark fails substantive examination, the examiner will notify the applicant in writing, stating the reasons for refusal. The applicant may submit a request for re-examination within 3 months from the date of receiving the refusal notice. Otherwise, the application will be deemed abandoned, and neither the filing date nor the application number will be retained. The applicant may apply for an extension upon payment of an extension fee. The trademark examiner may conditionally accept certain trademark applications and may require the applicant to disclaim rights to specific words or graphics in the trademark.
- Publication and Opposition: Once the trademark passes examination, it will be published in the official gazette of the Trademark Registry. Any party may file an opposition within 4 months from the publication date.
- Registration Approval: Trademarks ruled registrable after opposition or those with no opposition after publication will be approved for registration, and a registration certificate will be issued. The entire smooth application process (without issues such as refusal or opposition) typically takes 12–18 months.
Validity Period and Renewal of India Trademark Registration
A trademark is valid for 10 years from the registration approval date. To continue using the trademark after expiration, a renewal application must be filed within 6 months before the expiration date. Each renewal extends the validity by 10 years. India does not issue paper certificates for trademarks.
