I. Mexico Patent Application Pathways:
- Direct national application
- Paris Convention route (within 6 months from the priority date)
- Hague Agreement route (for industrial designs)
II. Required Documents for Industrial Design Application in Mexico:
- Design name, and the inventor's and applicant's name, address, nationality, and other details
- Product design drawings: perspective view (exploded view if applicable) and six orthographic views (front, rear, top, bottom, left, right). The scale must be consistent across all six views; reference views may be submitted if necessary.
- Brief description of the design
- If claiming priority: provide the acceptance notice of the earlier application and the priority document (priority must be claimed within 6 months)
- Power of Attorney (signed)
III. Industrial Design Application Process and Timeline in Mexico:
Process: Application → Examination → Grant → Publication
Timeline:
- Acceptance receipt issuance: 1–2 weeks
- Examination period: 18–24 months
Validity Period and Renewal:
An industrial design is valid for 5 years from the filing date. It can be renewed for additional 5-year terms, with a maximum total protection period of 25 years.
Renewal applications must be submitted within 6 months before expiration, with a 6-month grace period for late submission.
