eSearch plus covers all EU trademarks and applications. TMview integrates EUIPO data with national registers. TMclass contains the pre-approved terms required for Fast-Track qualification.
The EUTM is based on a single-registration principle: one application grants protection across all 27 EU Member States. The process involves:
· Step 1: Filing — Online application with EUR 850 fee (1 class). Immediate application number.
· Step 2: Formalities Check — EUIPO verifies mandatory information and fee payment. Deficiencies trigger a 2-month correction period.
· Step 3: Absolute Grounds Examination — EUIPO assesses distinctiveness, descriptiveness, and public policy. Only absolute grounds are examined; relative grounds are NOT examined.
· Step 4: Publication — Application published in the EU Trade Marks Bulletin. This triggers the 3-month opposition period.
· Step 5: Opposition Period — Third parties may oppose within 3 months. Fee: EUR 320. Cooling-off period: 2 months (extendable to 22 months).
· Step 6: Registration — If no opposition, or opposition resolved in applicant's favor, the mark is registered. Certificate issued.
Fast-Track Option: Applications using only TMclass terms, paid at filing, limited to word/figurative/shape/sound marks, with an EEA representative, can be examined and published within approximately 5 business days. The end-to-end registration timeline for an uncontested Fast-Track application is approximately 4 months.
Non-EEA Applicants: Must appoint a representative domiciled in the European Economic Area (EEA).
