South Korea Patent Application Guide
I. Types of Patents in South Korea:
- Invention Patent: Examination period 2-3 years, validity period 20 years
- Utility Model: Examination period approx. 2 years, maximum protection 15 years
- Industrial Design (Appearance Patent): Substantive examination required, examination period approx. 8 months, maximum protection 15 years
II. Required Documents for Industrial Design Application in South Korea:
- Application Information: Chinese and English names of applicant and inventor, address and postal code, country of application, contact person, etc.
- Design Drawings or Photos: The applicant must submit a perspective view (exploded view if applicable) and six orthographic views (front, rear, top, bottom, left, right).
- Brief Description of the Design
- If Priority is Claimed: Provide the acceptance notice of the earlier application and the priority document (priority must be claimed within 6 months).
III. Patent Application Process and Timeline in South Korea:
Process:
Application Stage → Examination Stage → Publication Grace Period → Deferred Publication
- Submit application for examination
- Respond to examination opinions (if any)
- Grant/Receive certificate
Note:
- For Industrial Designs Not Subject to Substantive Examination:
Application to grant takes approx. 5 months.
- For Industrial Designs Subject to Substantive Examination:
Notification of grant decision or examination opinion takes approx. 8 months.
- Both substantively examined and non-substantively examined industrial designs have a maximum protection period of 15 years.
- Products Eligible for Non-Substantive Examination System (short lifecycle, highly trendy products):
Clothing, bed linens, blankets, curtains, office paper, packaging paper, packaging containers, textiles, printed matter, etc.
- All other products require substantive examination for industrial design registration.
- All timelines mentioned above are subject to the actual examination progress of the official authorities.
