Required Documents for Trademark Registration
- Applicant information: name, nationality, address, etc.
- Trademark specimen
- Goods or services classification
- Priority document (if applicable)
- Power of Attorney (requires notarization)
Trademark Registration Process
- Application Submission: After submitting the required documents, the Department of Intellectual Property (DIP) will issue an application acknowledgment. The application information will be published in the official gazette and the online Cambodian trademark database maintained by WIPO.
- Formal Examination: The application requirements and classification information are reviewed. The acceptance period is approximately 2 weeks. If compliant, a filing date and application number will be granted.
- Substantive Examination: If the application fails the examination, a refusal notice will be issued. The applicant must respond within the specified timeframe stated in the notice; otherwise, the application will be deemed abandoned, and neither the filing date nor the application number will be retained.
- Registration: The applicant must pay the registration fee, after which the trademark registration certificate will be issued.
- Publication: The publication period is 90 days. Any interested third party may file an opposition within this 90-day period.
Validity Period, Renewal, and Declaration of Use
A Cambodian trademark is valid for 10 years from the filing date. Renewal can be filed within 6 months before expiration, with a 6-month grace period. Each renewal extends the validity by 10 years.
Evidence of use must be submitted between the 5th and 6th year from the registration date, and a second declaration of use is required between the 5th and 6th year after each renewal to maintain the validity of the registered trademark in Cambodia.
