Characteristics of Saudi Trademarks
- Saudi Arabia is a member of the World Intellectual Property Organization (WIPO) but not a member of the Madrid Protocol.
- The current Saudi Trademark Law and its implementing regulations came into effect on April 1, 1984. Trademark ownership is based on registration, covering goods trademarks, service trademarks, series trademarks, and collective trademarks.
- Saudi Arabia follows the International Classification of Goods and Services (Nice Classification). Registration is prohibited for pork products, bars, and any goods or services related to alcohol.
- Saudi Arabia adopts the 'first-to-file' principle and only allows single-class applications (one mark per class). Multi-class applications are not supported.
- Article 46 of the Trademark Law prohibits the use of trademarks identical or similar to already registered trademarks. Therefore, a comprehensive and strict search is required before registration to ensure no conflict with existing trademarks.

Trademark Registration Process
- Submission of documents
- Preliminary examination: Ensures completeness and accuracy of the submitted documents.
- Publication examination: After passing preliminary examination, the trademark application is published. During the publication period (60 days from the publication date), any party may file an opposition. The opposition response period is 30 days and cannot be extended.
- Registration examination: Further review of the trademark's legality, distinctiveness, and suitability.

Validity Period and Renewal
A trademark is valid for 10 Hijri years from the filing date (approximately 9 years, 8 months, and 13 days in the Gregorian calendar, based on the Islamic calendar).
Renewal can be filed within 6 months before expiration, with each renewal extending the validity by 10 Hijri years.
A grace period of 6 months after expiration is allowed for late renewal.
