Iran's trademark system is based on the 'first-to-file' principle, and Iran adopts the Nice Classification (45 classes in total).
Registration Pathways
Iran is a signatory to intellectual property treaties such as the WIPO Convention and the Paris Convention, and is also a member of the Madrid Protocol. Therefore, trademark registration in Iran can be processed either through single-country registration or via the Madrid International Trademark Registration system.
Required Documents for Trademark Registration
- For legal entities: Provide a copy of the company's business license. For individuals: Provide a copy of personal identification.
- Trademark specimen.
- Completed and signed Power of Attorney, which must be notarized.
- Detailed applicant information (in Chinese and English), including nationality, name, address, postal code, and contact details.
Trademark Registration Application Process
- Application Submission: Follows the 10th edition of the Nice Classification; allows multi-class applications; operates on the 'first-to-file' principle.
- Formal Examination: Compliant applications will be granted a filing date and application number.
- Substantive Examination: If a trademark fails the substantive examination, the examiner will notify the applicant in writing, stating the reasons for refusal. The applicant may submit a request for reexamination within the prescribed period from the date of receiving the refusal notice. Otherwise, the application will be deemed abandoned, and neither the filing date nor the application number will be retained.
- Publication/Opposition: Opposition period is 3 months.
- Registration: Approval of registration and issuance of the trademark registration certificate.
Important Notes
Goods containing alcohol in Class 33 and Class 32 are not eligible for registration.
Validity Period and Renewal
The trademark is valid for 10 years from the filing date. Renewal can be filed 6 months before the expiration date, with each renewal extending the validity by 10 years. A declaration of use must be submitted every 3 years from the date of trademark registration.
