Trademark Registration Process
- Application submission: Submit the trademark registration application online or offline.
- Examination: The Kazakh Patent Office will review the application, including the legality of the trademark and potential conflicts with existing registered trademarks.
- Publication: If the application passes examination, it will be published in the official gazette, and any party may file an opposition.
- Approval and registration: If no opposition is filed during the publication period, the trademark will be approved for registration, and a registration certificate will be issued.
Validity Period and Renewal
The trademark is valid for 10 years from the registration date. Renewal can be filed within 6 months before expiration, with each renewal extending the validity by 10 years.
A grace period of 6 months after the expiration date is allowed for late renewal.
Important Notes
The following cannot be registered:
- Names containing geographical indications for mineral water, wine, or spirits that indicate the goods do not originate from the relevant location.
- Use of translations or names accompanied by terms such as 'type,' 'style,' or other similar expressions.
