“优先权”在海外商标注册布局中的运用

根据《保护工业产权巴黎公约》第四条：
A.已经在本联盟的一个国家正式提出专利、实用新型注册、外观设计注册或商标注册的申请的任何人，或其权利继承人，为了在其他国家提出申请，在以下规定的期间内应享有优先权。

C.上述优先权的期间，对于专利和实用新型应为十二个月，对于外观设计和商标应为六个月。
就商标来说，如果在一个巴黎公约成员国首次提出商标注册申请之日起6个月内，又向其他成员国提出相同商标申请的，申请人在其他国家的申请可以享有首次申请的优先权，也就是说，在其他成员国的最早保护日期，可以追溯到首次申请的日期。
优先权对于企业在全球范围内注册保护新品牌具有重要意义。企业在确定一个新品牌以后，即便打算在全球范围内进行注册保护，但是由于各个国家的准备手续需要的时间不同，无法在同一天内提交所有注册申请，这中间可能就会存在被其他人抢注的情况，由于要求优先权可以将最早保护日期提前到首次申请的日期，那么企业就可以拥有更早的商标权利基础，优先权制度是为了保护企业的创新成果和智慧财产。同时，优先权制度也给了申请人一定的缓冲期，可以在6个月内认真考虑需要去哪个或者哪些国家提出注册申请。
优先权在海外商标注册时有预防抢注和打击抢注的作用。从预防抢注的角度，即便企业尚未遇到被抢注的情况，也可以主动要求优先权，预防可能的抢注发生。从打击抢注的角度，在发现抢注行为后，如果还在优先权的期限内，可以临时补充申请并要求优先权，虽然比抢注商标申请日晚，但是要求优先权就将最早保护日期提前到了首次申请日，可以化被动为主动，掌握案件的主动权。
