4、马德里商标的国内基础是5年内被驳回、提出异议无效，但是在5年后才最终失效，是否会遭遇中心打击？

很多企业都知道马德里商标注册后5年内和国内商标具有绑定关系，如果国内商标在5年内被驳回、被提出异议、无效、撤销等导致失效，那么就会遭遇中心打击。问题是，如果国内的申请或注册基础是5年内被驳回、被提出异议、无效、撤销，但是案件是在临近5年期限时才发起（如第四年半的时候被提出无效），结果是在5年后才出来导致失效，或者虽然案件结果在五年内已经出来，但是通过上诉、诉讼等方式拖延时间让基础商标在5年后才最终失效，那么是否仍然会遭遇中心打击？
答案是肯定的，中心打击不仅适用于在五年期限内启动的程序并且五年期限内失效的情况，也适用于在五年期限内启动的程序但是在五年期限后才失效的情况，企业咨询的通常是后面这一种情况，希望通过一些方式来规避中心打击。总的来说，马德里商标中心打击的适用期限，是以导致国内商标基础失效的原因产生的时间开始计算的，而不是以国内商标基础最终失效结果下发的时间计算的。
