7、马德里注册和单一国注册的保护效力是一样的吗？

根据马德里议定书 第四条 国际注册的效力
(1) (a)自根据第三条和第三条之三之规定所进行的注册或登记之日起，商标在各有关缔约方的保护与在该缔约方直接提交此商标申请所取得的保护应是相同的。如果没有根据第五条(1)和(2)将任何驳回通知寄到国际局或根据该条所通知的驳回于后被撤回的，自所述之日起，商标在有关缔约方的保护与该商标为该缔约国所注册的保护应是相同的。
所以，理论上来说通过马德里途径指定注册和通过单一国途径直接注册的保护效力是相同的。但是，实际代理工作中，根据从非洲律师处了解到的信息，部分非洲国家虽然加入了马德里体系，但是其国内商标法未进行修订，仍然有实际维权时不能得到有效保护的可能性，可能存在纸面权利的问题，建议在非洲进行商标保护时慎重考虑选择哪种途径。
