Chapter 1: Authoritative Sources and Information Channels

1.1 CNIPA Official Platforms

The China National Intellectual Property Administration (CNIPA), formerly known as the State Intellectual Property Office (SIPO), is the administrative authority under the State Council responsible for patent examination, authorization, and administration nationwide. For patent applicants, attorneys, and corporate IP managers, mastering CNIPA's official platforms is fundamental to conducting patent work in China.

1.1.1 China Patent Electronic Application System (CPEA)

The China Patent Electronic Application System (CPEA) is the primary online platform for filing patent applications, submitting documents, and tracking examination status. It supports invention patents, utility models, and design patents. Access: https://cponline.cnipa.gov.cn/

1.1.2 China Patent Search System (CPSS)

The China Patent Search System provides comprehensive search capabilities for granted patents and published applications, including advanced search, legal status queries, and patent family information. It covers over 40 million patent documents. Access: https://pss-system.cponline.cnipa.gov.cn/

1.1.3 Patent Reexamination and Invalidation System

The Patent Reexamination Board (PRB) handles reexamination and invalidation proceedings. Its online system allows electronic filing of reexamination requests, invalidation requests, and related documents. Access: https://reexam.cnipa.gov.cn/

1.2 Commercial Patent Databases

In addition to official platforms, the following commercial databases are widely used in practice: Derwent Innovation (manually indexed patent data), PatentSight (patent value metrics), Incopat (comprehensive Chinese patent data), PatSnap (AI-powered analytics), and Questel Orbit (global patent intelligence).

1.3 Legal and Case Law Resources

The Patent Examination Guidelines serve as the primary working guide for CNIPA examiners. The Patent Law of the People's Republic of China (amended in 2020) and its Implementing Regulations form the statutory framework. Judicial interpretations from the Supreme People's Court and guiding cases provide practical guidance on patent infringement and invalidation.

Understanding the authoritative sources for China patent information provides the foundation for all subsequent patent activities. With this knowledge in hand, we now turn to the core patent types and the application process in China, which forms the structural backbone of any patent strategy.


Chapter 2: Overview of China Patent Types and Application Process

2.1 China Patent Types Overview

The Patent Law of the PRC (2020 Amendment) establishes three types of patent protection: invention patents, utility model patents, and design patents. Each type has distinct protection scope, examination standards, and duration, making the selection of the appropriate patent type a critical strategic decision.

2.1.1 Invention Patents

Invention patents protect new technical solutions relating to a product or process. The protection term is 20 years from the filing date. Invention patents undergo substantive examination, with an average examination cycle of approximately 15.5 months (2024 data). In 2024, CNIPA granted 1.045 million invention patents, and the total number of valid invention patents reached 4.756 million.

2.1.2 Utility Model Patents

Utility model patents protect new technical solutions relating to the shape, structure, or combination of a product. The protection term is 10 years from the filing date. Utility models undergo preliminary examination only (no substantive examination), with a typical authorization cycle of 6-12 months. The application fee is CNY 500.

2.1.3 Design Patents

Design patents protect new designs that are aesthetically pleasing and suitable for industrial application. The protection term is 15 years from the filing date (extended from 10 years under the 2020 Amendment). Design patents also undergo preliminary examination, with an application fee of CNY 500.

2.2 Invention Patent Application Process

The invention patent application process includes: invention conception, patent search, drafting application documents, filing the application, formality examination, publication after 18 months, substantive examination (upon request), examination opinions, response/amendment, and grant or rejection. The applicant must request substantive examination within 3 years from the filing date (or priority date).

2.2.1 Direct Filing Route

Direct filing with CNIPA is the standard route for domestic applicants. The application must be filed in Chinese, with all technical documents translated if originally in another language.

2.2.2 Paris Convention Route

Under the Paris Convention, applicants may file in China within 12 months of the first filing in another member country, claiming priority. This is the most common route for foreign applicants entering the Chinese market.

2.2.3 PCT National Phase Entry

China is a PCT contracting state. International applications enter the Chinese national phase within 30 months from the priority date. China has consistently ranked first globally in PCT applications filed by residents, reflecting the country's growing innovation capacity.

2.3 Same-Day Dual Filing (2025 Update)

The 2025 Patent Examination Guidelines revision introduced refined rules for same-day dual filing (filing both an invention patent and a utility model patent for the same invention on the same day). Applicants must now make a clear declaration at the time of filing. The utility model will be automatically abandoned upon grant of the invention patent, unless the applicant actively withdraws the invention application to preserve the utility model.

Having established the patent types and application framework, the next critical step before filing is conducting thorough patent searches and risk assessments to ensure the proposed invention is novel and non-obvious, and that its commercialization will not infringe existing rights.
