Trademark Registration Application Process
- Application Submission;
- Examination: Formal examination;
- Publication: Approximately 30 days. The publication period may be extended upon request by a third party, with each extension lasting 30 days, up to a maximum of 120 days.
- Registration: The Intellectual Property Office of the Philippines (IPOPHL) will conduct a final review and approval of the trademark and issue the trademark registration certificate. Once the trademark registration certificate is obtained, the applicant becomes the legal owner of the trademark and enjoys exclusive rights to it.
Important Notes
In the Philippines, a Declaration of Actual Use must be submitted within specific periods after trademark registration:
- Between the 3rd and 4th year after registration;
- Between the 5th and 6th year after registration;
- At the time of renewal (every 10 years).
Validity Period and Renewal
A trademark in the Philippines is valid for 10 years from the registration date. It can be renewed upon expiry, with each renewal extending the validity by 10 years.
