I. Types of Patents in Taiwan
Patents are classified into three types: Invention Patents, Utility Model Patents, and Design Patents.
II. Required Documents and Timeline for Taiwan Patent Application
Required Documents:
- Complete set of patent documents in Chinese and English, including the description, claims, drawings, abstract, and prior art materials (patent literature, scientific and technical documents closely related to the invention known to the applicant). Electronic copies are required, especially for the text portions.
- Chinese and English name of the invention.
- Applicant's Chinese and English name and address (if the applicant is a company, provide the place of incorporation).
- Chinese and English names of the inventor(s). If the inventor is not the applicant, clarify the relationship between the applicant and the inventor.
- Power of Attorney: A Power of Attorney for the agent, signed and stamped by the applicant. Two copies are required for each application.
- Oath or Declaration: Signed and stamped by the inventor or creator, stating that the invention or creation in the patent application is not plagiarized from others. Multiple inventors may sign a single declaration.
