Non-Infringement Report
Part 1: What is a Non-Infringement Report?
A Non-Infringement Analysis Report is a formal legal document issued by a practicing attorney. It is based on facts and law, providing a professional analysis of whether your product infringes upon someone else's intellectual property rights (particularly trademark rights, copyrights, and design patent rights).
You can think of it as: an 'Certificate of Innocence' for your product in terms of intellectual property.
Part 2: What are the main contents of the report?
1. Case Background & Mandate
l Introduction: States who commissioned the attorney and specifies which Amazon infringement complaint (mentioning the complainant's name, the complained ASIN, or the trademark/patent registration number) is being analyzed.
l Analysis Objective: Clearly states that the report aims to analyze 'whether the Client's Product XX infringes upon Complainant YY's intellectual property rights.'
2. Factual Findings
l Your Product Information: Describes your product in detail, including product images, packaging images, listing detail page screenshots, and the trademarks/logos actually used.
l Complainant's Rights Information: Lists the details of the intellectual property rights that the complainant claims are infringed.
3. Legal Analysis (The Core of the Report)
This is the section where the attorney demonstrates professional judgment, providing point-by-point rebuttals and comparative analysis tailored to the type of complaint.
4. Conclusion
Summarizes the findings based on the various comparative analyses.
5. Attorney Credentials
Includes the attorney's contact information and their law firm details to enhance the report's credibility and authority.
Part 3: What is the role/purpose of the report?
A Tool for Rights Protection
Serves as supporting documentation for appeals, providing further protection for your rights.
Platform Appeals: If your listing is taken down due to a complaint, this report acts as powerful evidence for your platform appeal. A Non-Infringement Report from an attorney carries significantly more weight than a seller's own statement claiming 'I did not infringe.'
