CIPO Releases Its 2026-2031 Business Strategy: Fee Review, Provisional Patent Option and Two New Accelerated Examination Pathways

The Canadian Intellectual Property Office (CIPO) has released its 2026-2031 Business Strategy, setting out its vision and priorities for the next five years. The strategy, first released by CIPO on July 3, 2026, was developed using feedback collected in CIPO's 2025 SME Roundtables report.

The strategy revolves around four core priorities: delivering timely, high-quality IP products and services; advancing innovation in the knowledge-based economy; supporting Canada's trade priorities; and driving organizational excellence. Implementation will run through annual business planning, beginning with the 2026-2027 Business Plan, which translates the strategy into concrete actions and first-year deliverables.

Of particular note to Canadian patent and trademark applicants, CIPO indicates that it will commence a comprehensive fee review starting this winter, focused on simplifying payment processes and reducing administrative red tape. The Office is also working on its Next Generation Trademarks System (NGTS) to replace the current legacy system, and is considering a provisional patent option to enhance flexibility and lower barriers for innovators seeking early protection for their intellectual property.

CIPO further plans to introduce two new pathways for accelerated patent examination: a fee-based ultra-fast-track service designed to deliver patentability decisions within a defined timeframe or after a set number of office actions, and a no-cost accelerated stream targeted at technologies aligned with government priorities such as artificial intelligence, critical minerals, energy and defence. The proposals build on CIPO's public consultation on expedited examination programs, which closed on June 23, 2026.

The context is a patent system under pressure: average pendency from examination request to grant is approximately 34 months at CIPO, and existing expedited options — the Patent Prosecution Highway, special order (C$744.10 in 2026), green technologies and the COVID-19 relief pilot — accelerate queue position but impose no outer time limit on total prosecution.
