China-Brazil PPH Extended Until 2029
The China National Intellectual Property Administration (CNIPA) and the Brazilian National Institute of Industrial Property (INPI) have jointly decided to extend the China-Brazil Patent Prosecution Highway (PPH) pilot program effective January 1, 2025.
This marks a further deepening of cooperation in the intellectual property field between China and Brazil, providing a stable and reliable fast track for our patent strategy in Brazil.
New Changes in the Fifth Phase of Brazil PPH
According to INPI's Ordinance No. 48/2024, the guidelines for the fifth phase of the PPH program have been officially announced. The new application period will run from January 1, 2025, to December 31, 2029.
Compared to the past, the Brazilian PPH program shows several positive changes in this new phase:
1. Increased Application Quota: The total number of PPH applications accepted annually has been increased to 3,200, with no more than 800 per quarter.
2. Relaxed Classification Restrictions: The annual quota for PPH applications under the same International Patent Classification (IPC) Section has been increased to 1,000.
3. Application Limit Removed: The previous restriction limiting each applicant to one application per week has been removed, providing greater flexibility for applicants.
Strategic Value: A Key Lever for IP Strategy in the Latin American Market
For companies developing an IP portfolio in Brazil, utilizing the PPH alongside other acceleration channels like fast-track trademark examination can simplify procedures, shorten examination cycles, and significantly improve the efficiency and predictability of cross-border IP protection.
